That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time that we send the e-mail to you (whether or not you receive that e-mail). Any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England and Wales and you and The Memorial Garden irrevocably submit to the non-exclusive jurisdiction of the English courts.
We may subsequently not be able to ship the items requested, or may decide on reasonable grounds not to do so. Under these conditions we will offer you a refund or credit your credit or debit card. Such reasons may include (but are not limited to) safety concerns and fairness between customers where supplies are limited. We reserve the right, at any time prior to acceptance, to refuse any order or any part of an order, or to require further or better information to enable it to evaluate and/or process the order.
We use Streamline to validate your payment after we receive your order. Streamline uses software to check for fraudulent use and link to the banks for credit limits and notification of lost and stolen cards.
Without prejudice to the statutory rights afforded to consumers under English law or the consumer laws of other jurisdictions, we accept no liability for any failure to ship products where this results from its inability to do so or its decision on reasonable grounds not to do so, provided that it takes all reasonable steps to notify you within fourteen (14) days of order placement that products will not be shipped as ordered. In such cases we will not process any payment or will immediately refund any payment made, in full. In order to avoid disappointment, we strongly recommend that you order in good time to allow for processing and delivery of your order.
All of the items featured in the Memorial Candles part of this website are genuinely needed and used by the people, wildlife and programmers that The Memorial Garden supports. However, realistically, there are only so many stoves or snorkeling kits that anyone has need for and so if you have purchased an Memorial Candles your donation will not necessarily be used to purchase the item shown but will be used to help The Memorial Garden to continue with its full range of work right around the world. We aim to send you your Memorial Candles within 3 working days but please allow 7 working days.
